All praise is due to Allah, Lord of the Worlds. Prayers and salutations are upon our master Muhammad, upon his people, and all his companions.
Imam Nawawi stated, “Regarding when pregnancy is noticeable, it is not unlawful to divorce her.” (Rawdat al-Talibin 6/8) He also said, “Giving khul’ [a compensated release from marriage initiated by the woman] and divorce of one whose pregnancy is noticeable are permissible.” Khatib commented on it and said, “Even if she is menstruating because taking compensation and the manifestation of a pregnancy dismiss the possibility of regret.” (Mughni al-Muhtaj 4/499) And, Ibn Hajar mentioned something similar. (Tuhfat al-Muhtaj 8/79)

الحمد لله رب العالمين والصلاة والسلام على سيدنا محمد وعلى آله وصحبه أجمعين. وبعد:
قال قال الإمام النووي رحمه الله تعالى: أما إذا ظهر بها الحمل فلا يحرم طلاقها بحال. (روضة الطالبين 68) وقال أيضا: ويحل خلعها وطلاق من ظهر حملها. وشرح الخطيب رحمه الله تعالى على كلامه وقال: وإن كانت تحيض لأن بأخذ العوض وظهور الحمل ينعدم احتمال الندم اهـ (مغنى المحتاج 4499) وذكر ابن حجر رحمه الله تعالى نحوه. (تحفة المحتاج 879)
